Partner Terms of Service

This Partner Terms of Service ("Terms") constitutes a legally binding agreement between QikStitch Services Private Limited ("QikStitch") and independent service partners including tailoring professionals, tailoring shops, boutiques, delivery partners, and logistics service providers ("Partners") using the QikStitch platform.
By registering, accessing, or using the QikStitch Partner platform, you agree to comply with these Terms, applicable laws, and QikStitch policies.
1. Partner Eligibility and Verification
Partners must provide accurate, complete, and updated information during registration and onboarding.
- Partners must provide valid identity, business, bank, vehicle, and other verification details requested by QikStitch.
- Tailor Partners must provide accurate shop information, service details, portfolio information, and applicable business registrations.
- Delivery Partners must provide accurate personal details, vehicle information, and legally required documents where applicable.
- QikStitch reserves the right to verify, approve, reject, suspend, or remove Partner accounts based on verification results, service quality, compliance requirements, or marketplace standards.
2. Relationship with QikStitch
Partners are independent service providers and are not employees, agents, franchisees, or representatives of QikStitch.
QikStitch provides a technology platform that connects customers with independent tailoring and delivery service providers.
Partners remain responsible for their own business operations, employees, equipment, vehicles, taxes, licenses, and legal compliance.
3. Partner Account Security and Platform Usage
- Partners are responsible for maintaining the confidentiality of their QikStitch account credentials and OTP authentication.
- Partners must provide accurate information and must not create fraudulent accounts or misleading profiles.
- Partners must not misuse customer information or platform features.
- Partners must not bypass QikStitch by directly accepting payments or future transactions from customers introduced through the platform.
- Partners must use the QikStitch platform only for legitimate business purposes.
4. Tailor Partner Responsibilities
This section applies specifically to tailoring professionals, shops, boutiques, and stitching service providers registered on QikStitch.
4.1 Catalog and Service Accuracy
- Tailor Partners are responsible for ensuring service categories, service items, descriptions, prices, images, designs, and turnaround times are accurate.
- Partners must not upload misleading images, unauthorized copyrighted content, or services they cannot provide.
- Partners must update availability, pricing, and service information whenever changes occur.
4.2 Order Processing and Quality Standards
- Tailor Partners must accept or reject orders within the platform-defined time period.
- Services must be completed with reasonable skill, care, and professionalism.
- Garments must match approved designs, specifications, measurements, and customer requirements.
- Material substitutions or major changes require customer approval.
4.3 Measurements and Alterations
Tailor Partners must carefully review customer measurements, designs, and customization instructions before production.
Alterations caused by Partner workmanship issues, incorrect execution, or deviation from confirmed specifications may require corrective action from the Partner.
Alterations caused by customer preference changes, incorrect customer measurements, or additional customization requests may involve additional charges.
5. Delivery Partner Responsibilities
This section applies specifically to delivery partners providing pickup and delivery services through QikStitch.
5.1 Delivery Assignments
- Delivery Partners must accept or reject assigned delivery tasks within the specified timeframe.
- Partners must complete pickup and delivery activities according to the instructions provided through the platform.
- Repeated cancellations, fake delivery attempts, or unnecessary delays may affect account status.
5.2 Pickup Responsibilities
- Delivery Partners must verify order details before collecting packages.
- Packages must be handled carefully and delivered without unauthorized opening, modification, or misuse.
- Delivery Partners must confirm pickup through approved QikStitch verification methods where applicable.
5.3 Delivery Responsibilities
- Delivery Partners must deliver orders only to the intended customer or authorized recipient.
- Delivery confirmation methods such as OTP verification must be followed where applicable.
- Delivery Partners must comply with applicable traffic, safety, and transport laws.
5.4 Location Usage
Delivery Partners acknowledge that location information may be accessed while actively using delivery-related features for navigation, pickup coordination, route assistance, and delivery status updates.
6. Customer Data Protection and Confidentiality
Partners may access customer information only for completing specific QikStitch services.
- Customer information must not be sold, shared, copied, or used for personal marketing purposes.
- Partners must not contact customers outside the purpose of completing the assigned order or delivery.
- Partners must protect customer information in accordance with applicable privacy laws including the Digital Personal Data Protection Act, 2023.
7. Payments, Commissions and Earnings
- Tailor Partner payouts and Delivery Partner earnings shall be processed according to QikStitch payment schedules and applicable agreements.
- QikStitch may deduct applicable platform fees, commissions, taxes, refund adjustments, penalties, disputes, or recoverable amounts where applicable.
- Partners are responsible for providing accurate bank account and payment details.
- QikStitch reserves the right to modify commercial structures with appropriate notice.
8. Pickup, Delivery and Service Performance
Partners must maintain professional service standards and complete assigned activities within committed timelines.
- Repeated delays, poor service quality, customer complaints, or failure to complete accepted tasks may impact Partner visibility, ranking, earnings, or account status.
9. Intellectual Property and Marketing Rights
Partners retain ownership of their trademarks, brand identity, and proprietary business information.
Partners grant QikStitch a non-exclusive right to display approved business information, service details, ratings, reviews, and portfolio content for platform operation, marketing, and promotional purposes.
10. Reviews and Ratings
Customer ratings and feedback may influence Partner visibility and marketplace performance.
Partners must not manipulate reviews, request fraudulent ratings, or misuse customer feedback systems.
11. Prohibited Activities
- Fraudulent transactions or fake service completion.
- Misuse of customer information.
- Bypassing QikStitch payments or commissions.
- Uploading false information or unauthorized content.
- Any activity harmful to customers, partners, or the QikStitch platform.
12. Suspension and Termination
QikStitch may suspend, restrict, or terminate Partner accounts for:
- Fraudulent activity.
- Repeated customer complaints.
- Poor quality or delayed services.
- Violation of these Terms.
- Data misuse or platform abuse.
- Illegal activities.
13. Liability and Indemnification
Partners are responsible for their own services, workmanship, delivery activities, business operations, and legal obligations.
Partners agree to indemnify and hold harmless QikStitch, its directors, employees, and affiliates against claims, damages, losses, or expenses arising from Partner actions, negligence, violations, or misuse of the platform.
14. Dispute Resolution and Governing Law
These Terms are governed by the laws of India.
Any disputes shall first be attempted to be resolved through good-faith discussion.
Unresolved disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in Anantapur, Andhra Pradesh, India.
15. Force Majeure
Neither party shall be responsible for delays or failure to perform obligations caused by events beyond reasonable control, including natural disasters, government restrictions, internet failures, payment gateway outages, transportation disruptions, strikes, technical failures, or other unforeseen events.
